Article 1614
Disregard of Contractual Relationship
(1)
Whosoever is aware, of the existence of a contract between two persons commits a fault where he concludes with one of those persons a contract which renders substantially impossible the performance of the first contract.

He is not liable however, where the person complaining of the breach of the first contract has failed to take the measures which would have ensured the effective performance of that contract.
