Article 662

An acknowledgment is null and void if it has been made:

without the mother’s consent if the child is under fifteen years of age; or

without the child’s consent if the child is fifteen years or older.

The consents mentioned in the paragraphs (1) (a) and (b) can be substituted by the Court, if the acknowledgment is not contrary to the child’s interests, and provided that the man is the biological father of the child.

If the mother is dead or not in a position to manifest her will, the acknowledgment of paternity may be accepted by the maternal grandfather or grandmother of the child.
