Article 120

Proceedings in the Supreme Court

The Supreme Court may order that the High Court try the defendant in his absence upon finding that:

(1)

the accused was charged with Class 1 through Class 7 Serious Offences;

(2)

the accused received notice of the trial date and place;

(3)

the accused failed to appear for trial at that place and time; and

(4)

the interests of justice will be served by bringing the defendant to trial in his absence.
