Article 916
Failing Agreement between Heirs
(1)
Failing an agreement between the heirs or where one of the heirs contests the modalities or some aspects of the partition, the contested plan shall be submitted to the Court by the most diligent of the co-heirs.
#(2)
The Court may set down the manner of effecting the partition, or effect the partition itself. The provisions of this Chapter shall apply where appropriate.
