Article 1934
Insolvency of Borrower
(1)
The lender may refuse to deliver the promised thing if the borrower has become insolvent after the contract of loan is concluded.
#(2)
The lender may do so notwithstanding that the borrower was insolvent at the time he concluded the contract of loan if the lender knew of this insolvency only after the contract of loan is concluded.
