Article 1714
Right of Retention
(1)
The person bound to make restitution may refuse to return the thing until he has received payment of the indemnity due to him under the foregoing provisions or until he has received adequate security for its payment upon liquidation of the amount due.
#(2)
The right of retention may, however, not be invoked by a thief or by a person who, at the time when he took possession of the thing, knew that he had no valid contractual or legal right to it.
